This End-User License Agreement (“EULA”) is a legal agreement between the end user person/entity (“You”) and Mistral Solutions Private Limited (“Mistral”). Subject to the provisions of this EULA, Mistral hereby grants to You a non-exclusive license to download, install and use (“Use”) the AM437x Android Demo Image Software (“Software”).
COMPLIANCE WITH APACHE LICENSE VERSION 2
The Software is a derivative work of Google’s Kit-Kat AOSP. The Android port for the AM437x General-Purpose Evaluation Module developed by Texas Instruments uses Google’s Kit-Kat AOSP Code-base and custom software patches developed by Mistral to enable the working of Android Kit-Kat on it.
This license is issued to You in compliance with the terms and conditions of Apache License Version 2.0 (“Apache License”). You shall Use the Software and any files associated with the same only in compliance with the terms and conditions of the Apache License and this EULA.
You hereby agree to comply with the provisions of Apache License Version 2, a copy of which is available at http://www.apache.org/licenses/LICENSE-2.0 and attached to this agreement as Annexure I.
This License does not grant You permission to use the trade names, trademarks, service marks, or product names, including the name “Android” and the logo, owned of Google and/or the Apache Software Foundation, except as required for reasonable and customary use in describing the author of the Software.
RESTRICTIONS
You may not decompile, disassemble or otherwise reverse engineer the Software, or engage in any other activities to obtain underlying information that is not visible to the user in connection with normal use of the Software. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Software. You agree not to publicize or distribute any codes used by this Software without obtaining prior approval in writing from Mistral.
You shall not use the Software to engage in or allow others to engage in any illegal activity. You shall also not use the Software to engage in any activity that violates the rights of third parties, including, without limitation, through use, public display, public performance, reproduction, distribution, or modification of communications or materials that infringe copyrights, trademarks, publicity rights, privacy rights, patents and other proprietary rights, or rights against defamation of third parties.
DISTRIBUTION
You agree not to distribute the Software (including distribution on CD-ROM, disk, or other physical media) to any person without obtaining the prior approval of Mistral in writing. You shall not sub-license the Software or assign the license to any person without obtaining the prior approval of Mistral in writing.
TERMINATION
THIS LICENSE MAY BE TERMINATED BY MISTRAL AT ITS DISCRETION AT ANY TIME AND WITHOUT ANY PRIOR NOTICE TO YOU. THIS LICENSE SHALL TERMINATE AUTOMATICALLY IN CASE YOU FAIL TO COMPLY WITH THE TERMS AND CONDITIONS OF THIS EULA AND/OR THE APACHE LICENSE.
DISCLAIMER OF WARRANTIES
THIS SOFTWARE, OTHER RELATED SOFTWARE, FILES AND SERVICES ARE PROVIDED ON AN “AS IS,” BASIS WITH NO WARRANTIES WHATSOEVER. MISTRAL AND SUCH OTHER THIRD PARTIES EXPRESSLY DISCLAIM TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS AND ANY WARRANTIES REGARDING THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THE SOFTWARE, OTHER RELATED SOFTWARE, FILES AND SERVICES. MISTRAL DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS. MISTRAL FURTHER DOES NOT WARRANT THAT THE OPERATION OF THE SOFTWARE SHALL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SOFTWARE OR SERVICE WILL BE CORRECTED. NO ORAL OR WRITTEN STATEMENT, INFORMATION OR ADVICE GIVEN BY MISTRAL, ITS EMPLOYEES, DISTRIBUTORS, DEALERS, OR AGENTS SHALL CREATE ANY WARRANTIES IN RELATION TO THIS SOFTWARE, OTHER RELATED SOFTWARE, FILES AND SERVICES.
YOU UNDERSTAND AND AGREE THAT YOUR DOWNLOAD AND/OR USE OF THE SOFTWARE, AND ALL THIRD PARTY SOFTWARE MADE AVAILABLE IN CONJUNCTION WITH OR THROUGH THIS SOFTWARE OR SERVICE, IS AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF THE SOFTWARE, RELATED SOFTWARE AND/OR SERVICES.
LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES SHALL MISTRAL, OR ITS SUPPLIERS, RESELLERS, PARTNERS OR THEIR RESPECTIVE AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SOFTWARE, WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, (EVEN IF ANY SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES).
THE SOFTWARE IS NOT INTENDED FOR USE IN CONNECTION WITH ANY NUCLEAR, AVIATION, MASS TRANSIT, OR MEDICAL APPLICATION OR ANY OTHER INHERENTLY DANGEROUS APPLICATION THAT COULD RESULT IN DEATH, PERSONAL INJURY, CATASTROPHIC DAMAGE, OR MASS DESTRUCTION, AND YOU AGREE THAT THE SOFTWARE WILL HAVE NO LIABILITY OF ANY NATURE AS A RESULT OF ANY SUCH USE OF THE SOFTWARE.
